1. Provider details

VoltMage is the operating brand used for this website and platform (“VoltMage”, “we”, “us”, “our”). The legal contracting party and its statutory details are identified in the applicable proposal, order form, statement of work or master services agreement.

  • Website: https://voltmage.ai
  • Commercial and legal contact: Office@voltmage.ai
  • Privacy contact: privacy@voltmage.ai
Enterprise agreements If you sign an MSA/SOW/SLA/DPA with us, those documents may add or replace parts of these Terms for the relevant services.

2. Scope & acceptance

By accessing or using the website, platform, APIs, documentation, demos, or any related services (collectively, the “Services”), you agree to these Terms. If you use the Services on behalf of a legal entity, you confirm you have authority to bind that entity.

These Terms apply to: (a) public website usage; and (b) platform access (SaaS, hosted, managed, or enterprise deployments), unless superseded by a written agreement.

3. Accounts & access

  • Registration. Some Services require an account. You must provide accurate information and keep it updated.
  • Credentials. You are responsible for safeguarding credentials and for all activity under your account.
  • Authorized users. Access may be limited to named users, seats, or other terms described in your order/SOW.
  • Minimum age. The platform is intended for professional/enterprise use. If consumer use occurs, users must be at least 18 years old or have legal capacity under applicable law.

4. Services, orders, trials

We may offer a public site, platform access, pilots, proofs-of-concept, demos, paid subscriptions, and professional services. Any commercial terms (scope, pricing, milestones, deliverables) may be defined in an order form, proposal, SOW, or MSA.

  • Trials & demos. Trials may be time-limited and provided “as-is” unless explicitly stated otherwise.
  • Professional services. If we deliver integration, configuration, or consulting, those are governed by the applicable SOW or written statement.
  • Changes. Scope changes require mutual written agreement and may affect timeframes and fees.

5. Fees & invoicing

Fees and payment terms are set in your commercial documents (order form/SOW/proposal). Unless stated otherwise:

  • Currency & taxes. Fees are exclusive of VAT and applicable taxes, which may be added where legally required.
  • Invoices. We may invoice electronically. You consent to electronic invoicing where permitted by law.
  • Late payments. Late payments may accrue statutory interest and/or contractual penalties where permitted.
  • No set-off. Payments are due without set-off unless mandatory law requires otherwise.
Important If you are a consumer (rare for this platform), mandatory consumer protections may apply to certain payment/withdrawal rules.

6. Acceptable use

You agree not to misuse the Services. Prohibited activities include:

  • Attempting to gain unauthorized access to systems, accounts, or data.
  • Reverse engineering, decompiling, or attempting to derive source code, except to the extent permitted by mandatory law.
  • Interfering with or disrupting service availability (e.g., denial-of-service).
  • Using the Services to store or transmit unlawful content, malware, or malicious code.
  • Violating third-party rights (privacy, IP, confidentiality) or applicable laws/regulations.
  • Using the Services for safety-critical control without agreed safeguards and testing gates.

7. Security & incident handling

We implement appropriate technical and organizational measures designed to protect the confidentiality, integrity, and availability of the Services. Specific security commitments (including audit rights, penetration testing rules, or incident SLAs) may be defined in an enterprise agreement or DPA.

  • Your responsibilities. Maintain secure credentials, enforce least privilege, and promptly notify us of suspected compromise.
  • Incident response. We will act to contain and remediate security incidents within commercially reasonable timeframes.
  • Shared responsibility. Security depends on both parties, especially where we deploy into your environment.

8. Data & privacy

“Customer Data” means data you (or your users/devices) submit to the Services, including telemetry, operational signals, or configuration data. As between you and us, you retain ownership of Customer Data.

  • Data processing. Personal data (if any) is handled in accordance with our Privacy Policy and applicable data protection laws (e.g., GDPR and Bulgarian data protection rules).
  • Processor/Controller roles. For platform processing of customer data, we typically act as a processor and you act as controller (subject to the nature of the processing). A DPA may be required for production use.
  • Data retention. Retention depends on contract, legal obligations, and operational needs. Deletion/export terms may be specified in your agreement.
  • Confidentiality. Customer Data is treated as confidential information where applicable.

9. Intellectual property

We and our licensors own all rights, title, and interest in the Services, including software, UI, APIs, documentation, trademarks, and know-how. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes during the term.

  • Restrictions. No resale, sublicensing, or making the Services available to third parties, unless explicitly permitted.
  • Feedback. If you provide feedback, you grant us the right to use it without restriction or compensation (unless prohibited by law).
  • Customer materials. You grant us a limited license to use Customer Data solely to provide and improve the Services, subject to privacy commitments.

10. Third-party services

The Services may integrate with third-party systems (SCADA, inverters, EMS, market data, cloud services, messaging providers). Third-party services are governed by their own terms and privacy policies, and we are not responsible for third-party performance or outages.

11. Availability & support

We aim to provide reliable services, but uptime, maintenance windows, support channels, and response times may vary by plan and are typically defined in an SLA or support policy.

  • Maintenance. Planned maintenance may occur and may temporarily affect availability.
  • Beta features. Beta/preview features may be offered without warranties and may change or be discontinued.
  • Support. Support scope depends on your subscription or SOW.

12. Warranties & disclaimers

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available.” We disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are prohibited by mandatory law.

The Services may provide forecasts, simulations, and optimization recommendations. Outputs are informational and depend on input quality and assumptions. You remain responsible for operational decisions, compliance, and safe deployment.

13. Liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, business, or goodwill, arising out of or relating to the Services.

To the extent permitted, our aggregate liability for all claims relating to the Services is limited to the amounts paid by you for the Services during the 12 months preceding the event giving rise to the claim (or another cap if stated in an enterprise agreement).

Mandatory law Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., certain consumer rights, willful misconduct, or personal injury where relevant).

14. Indemnity

  • By you. You agree to indemnify and hold us harmless from claims arising from your misuse of the Services, violation of law, or infringement using Customer Data or your configurations.
  • By us (IP). Where agreed in an enterprise contract, we may provide limited indemnity for claims that the unmodified Services infringe third-party IP rights, subject to standard exclusions and procedures.

15. Suspension & termination

  • Suspension. We may suspend access for security reasons, suspected abuse, or non-payment (where applicable), and will restore access when the issue is resolved.
  • Termination. Either party may terminate as permitted by contract. Enterprise agreements may define notice periods and termination effects.
  • Effect. Upon termination, your right to use the Services ends. Data export/deletion may be handled per agreement and applicable law.

16. Consumer information

VoltMage.ai is designed primarily for business and professional users. If you are a consumer (natural person acting outside trade/profession), mandatory consumer protection rules under Bulgarian and EU law may apply and may override certain clauses (e.g., unfair terms rules, withdrawal rights for distance contracts, statutory guarantees).

  • Distance contracts. If applicable, you may have statutory information and withdrawal rights for certain digital services, subject to legal exceptions.
  • Complaints. Consumers may have access to dispute resolution mechanisms under EU frameworks (where applicable).

If you believe you are contracting as a consumer, please contact us before purchase so we can provide the appropriate statutory disclosures.

17. Export & sanctions

You may not use the Services in violation of applicable export control, sanctions, or trade laws. You represent that you are not located in, under the control of, or a national/resident of any restricted jurisdiction where providing the Services would be unlawful.

18. Governing law & disputes

Unless otherwise agreed in writing, these Terms are governed by the laws of the Republic of Bulgaria, taking into account mandatory provisions of applicable EU law where relevant.

Any disputes arising out of or relating to these Terms shall be subject to the jurisdiction of the competent courts in Sofia, Bulgaria, unless mandatory law requires otherwise or the parties agree on arbitration/other venue in an enterprise agreement.

19. Changes to these Terms

We may update these Terms from time to time to reflect changes in Services, law, or business practices. We will post the updated version on this page and update the “Last updated” date. Material changes may be notified through the platform or via email where appropriate.
